CRIME- Definition and Outline


Definition
“An act committed or an omission of duty, injurious to the public welfare, for which punishment is prescribed by law, imposed in a judicial proceeding usually brought in the name of the state.  Eg R vs Joe Blox”

Types of Crime

1.     Economic
§  Most common
§  Damage to or loss of the victim’s property
§  More than 200 listed in the Crimes Act 1900 (NSW)
a) Property
b) White Collar

2.     Offences against the State
3.     Drug Offences
4.     Public Order Offences
5.     Traffic Offences
6.     Victimless crimes
§  Arguments for based on social moral or religious grounds
§  Damaging to society
§  Does not threaten another person or property
§  Eg homosexuality prior to 1980s, illegal drug use
7.     Preliminary crimes
§  Attempts
§  Punishable by the same penalty as if the crime had taken place s344A Crimes Act (NSW)
